An [aluminum fence](https://portillo-fences.com/aluminum-fencing/) around a [Brewster](https://portillo-fences.com/brewster-ny/) pool has to stand at least 48 inches above grade, with no more than 2 inches between the ground and the bottom of the barrier, under Section R328.4.2.1 of the 2025 Residential Code of New York State. The permit comes from the Village Code Enforcement Officer if the parcel is inside the Village of Brewster, or from the Town of Southeast Building Inspector if it is on Brewster Hill, in Dykemans or at Deans Corners.

Neither municipality sorts open ornamental fence from solid fence. Both limit height and location, so a four-foot picket fence and a four-foot solid fence meet the same height rule.

## Which office, and what it requires

The Village Office of Code Enforcement is at 50 Main Street, (845) 279-3760, open Monday through Thursday from 8:00 a.m. to 5:30 p.m. and closed Friday. The Town of Southeast Building Department is at 1 Main Street, (845) 279-2123, with Town offices open Monday through Friday from 9:00 a.m. to 4:30 p.m. A [Brewster](https://portillo-fences.com/brewster-ny/) mailing address does not put an unincorporated property under village rules, so confirm the boundary on your tax record before filing.

In the Town, Chapter 138 allows a fence or wall of 3 feet along any lot line and 6 feet behind the required front yard, and up to 10 feet only when it sits back from the lot line by two-thirds of the required setback. Nothing over 3 feet may stand in the sight triangle at a street intersection. The Village caps a fence at 4 feet in a front yard and 6 feet in a rear yard, with no separate open-versus-solid rule.

The Village schedule dated April 4, 2019 lists a $100 permit fee for fences and walls over 36 inches, plus $5 per thousand of demolition cost, and a $100 Certificate of Occupancy or Compliance. The Village has posted a revised schedule, so confirm the current figure. Its permit instructions ask for a completed application, the tax map number, your contractor's license number, a description of the work, and liability insurance and workers' compensation documentation. The Town's 2026 schedule lists $150 for a project under $10,000, $330 from $10,000 to $30,000, $330 plus $6 per thousand above that, a $55 Certificate of Occupancy and Compliance and a $75 re-inspection fee, with no aluminum-specific line. Under Chapter 138 the Building Inspector approves or denies a building permit within 15 working days when no site plan or special permit approval is needed, and residential fences on residential properties skip Architectural Review Board review. Ask the Village office for its review time.

## The 2025 pool barrier numbers

New York's 2025 code took full effect on December 31, 2025, and the Department of State points to Section R328 for residential pools. For a picket-style aluminum barrier, the sections that matter are:

- **R328.4.2.1**: at least 48 inches above grade and no more than 2 inches between grade and the bottom of the barrier, both measured on the side facing away from the pool
- **R328.4.2.3**: where horizontal members are less than 45 inches apart, vertical openings no wider than 1-3/4 inches
- **R328.4.2.4**: where horizontal members are 45 inches or more apart, vertical openings no wider than 4 inches, with decorative cutouts still held to 1-3/4 inches
- **R328.4.2.7 and its subsections**: [gates](https://portillo-fences.com/gates/) meet the opening and height rules, are self-closing and self-latching, and a pedestrian gate opens outward, away from the pool
- **Locking**: all gates securely locked with a key, combination or child-proof lock when the pool is not in use or supervised

The code does not approve an aluminum product by name, so the panel, picket spacing, horizontal-member layout, bottom clearance and gate hardware are each checked against these sections. The permit follows the code the local authority enforces. ASTM F2408-16(2023) covers coated tubular picket ornamental fence made from galvanized steel, and the aluminum-specific standard is ASTM F2957-13(2025), Ornamental Aluminum Fence Systems. Our [pool barrier rules guide](https://portillo-fences.com/blog/ny-pool-barrier-rules/) and the [pool fencing](https://portillo-fences.com/pool-fencing/) page cover the rest of the barrier.

![Aluminum picket panels and line posts on a pallet with a spacing gauge resting across the pickets](https://portillo-fences.com/images/blog/aluminum-fencing-brewster-ny/panels-and-spacing-gauge.jpg)

Vertical openings top out at 1-3/4 inches when horizontal members are less than 45 inches apart.

## Slopes: racking, stepping and gates

Rackable panels follow the grade by letting rails and pickets adjust between posts. Stepped panels stay level and change elevation at the posts. UltraLox's instructions say panels may be racked up to 8 degrees, that sloped terrain shortens the distance between posts, and that over-adjusting leaves pickets loose or rattling. Test-fit panels on the ground and cut at an angle where needed. ActiveYards' racking gate instructions give a maximum of 10 degrees, or 12-3/4 inches of elevation change, for the configuration in that guide. Those limits belong to each product line, so check the rack rating of the system you buy.

Gates generally cannot be racked, because the hinge and latch posts have to stay plumb and level with each other. When the slope exceeds a panel's rack rating, use stepped panels, shorter sections or a slope-specific bracket. A pool barrier has to hold its 2-inch bottom clearance and its opening limits through every grade change.

Panels may be racked up to 8 degrees in UltraLox's instructions, and gates may not be racked at all.

## Footing depth

New York leaves the minimum footing depth to each jurisdiction through Table R301.2(1), and the state table does not enter a [Brewster](https://portillo-fences.com/brewster-ny/) or Southeast figure for you. Ask the Village Office of Code Enforcement or the Town Building Inspector for the depth at your address before excavation.

## What aluminum fencing costs

These are planning figures from different regions and assumptions, so each keeps its own scope. A local bid should separate panel style, height, grade, gates, post count, excavation, rock or ledge, slope work and permit costs.

## Published aluminum fence prices per linear foot installed

Installed price: $22 to $35

Source and scope: FenceCalc, national, 2026

Tap a row to open it.

FenceCalc ties price to wall thickness. Residential grade runs 0.030 to 0.050 inches, commercial grade 0.055 to 0.065 inches at 25% to 40% more, and industrial grade 0.080 inches or more at 50% to 80% more.

## Gates, posts and lead times

FenceCalc's project examples price two walk gates on a 200-foot, 4-foot ornamental fence at $600 total, a pool gate with hardware on an 80-foot, 5-foot enclosure at $450, and a drive gate on a 150-foot, 6-foot privacy fence at $1,200. FairFences lists a walk gate at $350, a double gate at $550 and a sliding gate at $1,200. Gate posts cost more than line posts. In Fence Deck Supply's August 2026 material list, a 48-inch Concord line post is $35.32 and the gate post is $54.53, and a 48-inch Concord walk gate is $316.43. A 60-inch Lexington line post is $37.30 against $58.85 for the gate post. Those are material prices, not installed ones. A contractor's published figure puts a custom sloped aluminum gate at about $45 over a regular gate. Ask for corner posts as their own line.

Manufacturing time matters in planning. Ametco states a typical lead time of 8 to 10 weeks after approved, field-verified drawings for custom aluminum and architectural products. SHAPES Unlimited ships in-stock material in 5 to 7 days, quotes non-stocked material at anywhere from 1 to 2 weeks up to 10 to 16 weeks depending on product category, and aims for 4 to 5 weeks on assembled fence products. Custom color and dimensions can extend both.

## Frequently Asked Questions

**Q: Does a decorative picket top change the spacing rule?** A: Decorative cutouts in vertical members stay limited to 1-3/4 inches even where horizontal members are 45 inches or more apart.

**Q: Which way must a pool gate open?** A: A pedestrian pool gate opens outward, away from the pool, and every gate is self-closing and self-latching under Section R328.4.2.7.

**Q: Can aluminum panels follow a slope?** A: Rackable panels can, within the product's rack rating, which is up to 8 degrees in UltraLox's instructions. Steeper grades call for stepped panels, shorter sections or slope brackets.

**Q: How much is a permit?** A: The Town's 2026 schedule lists $150 for a project under $10,000. The Village schedule dated April 4, 2019 lists $100 for fences over 36 inches, and a revised Village schedule has since been posted.

**Q: How long until the fence arrives?** A: Stocked material ships in 5 to 7 days at SHAPES Unlimited, and custom products run 8 to 10 weeks at Ametco after approved drawings.

**Q: Does the same fence work as a pool barrier?** A: Only if its height, bottom clearance, spacing and gates meet Section R328. Confirm with the building official before the order is placed.

Aluminum quotes compare cleanly when they list the height, wall grade, picket spacing, gates, post count and slope work, and say whether the pool sections apply. Confirm the permit office and the rack rating before ordering panels.
