- Gate Permits

An [automatic gate](https://portillo-fences.com/automatic-gates/) in [Brewster](https://portillo-fences.com/brewster-ny/) needs a building permit before anyone digs or runs power, and the office that issues it follows the property, not the Brewster mailing address. Inside the village, call the Village Building Department at 50 Main Street, (845) 279-3760. On Brewster Hill, in Dykemans or at Deans Corners, the Town of Southeast Building Department at 1 Main Street, (845) 279-2123, issues it.

For a Town property the 2026 fee schedule starts at $150 for a project under $10,000, and the Building Inspector has 15 working days to approve or deny once the application is filed. The Village's fee for a gate is one to confirm by phone before you file.

![A residential driveway opening between two stone piers with a conduit stub in the grass and no gate hung yet](https://portillo-fences.com/images/blog/automatic-gates-brewster-ny/driveway-opening-before-gate.jpg)

A permit comes before excavation or electrical work, and work done before the permit is issued carries a $250 fee in the Town schedule.

## Key Takeaways

Jurisdiction follows the parcel

the Village Building Department at (845) 279-3760 or the Town of Southeast at (845) 279-2123

Town permit fees

$150 under $10,000, $330 from $10,000 to $30,000, $330 plus $6 per thousand above that

Review clock

the Town Building Inspector approves or denies within 15 working days after filing, unless site plan or special permit approval comes first

Safety standard

UL 325 requires two monitored entrapment protection devices at each entrapment zone, on residential operators too

Fire access

a gate across a fire apparatus road needs fire code official approval and an emergency means of operation

Published installed cost

$2,380 to $8,000 nationally, with Westchester practice ranges from $2,800 to $9,500

## Permits, fees and inspections

The Town's 2026 fee schedule lists these Building Department lines:

- **Project under $10,000**: $150
- **Project from $10,000 to $30,000**: $330
- **Project over $30,000**: $330 plus $6 per thousand
- **Large project over $100,000**: $825 plus $5 per thousand
- **Work performed before the permit is issued**: $250
- **Re-inspection or no-show**: $75

The schedule has no separate fence or gate line, so the Building Department classifies the job by its value and scope. The Town says a building permit is required before excavation, construction or installation of electrical systems. Town Code Chapter 54 adds that fire underwriters assist enforcement officers with electrical code review and are not Town employees, which points to a third-party electrical inspection. The Town inspects construction at required intervals, so ask which inspections apply to a gate and when to schedule each one.

The Village permit application has fields for fence and other work, with proposed construction cost and cost of permit. Ask the Village office which category an automatic gate falls under and what the permit and the electrical review cost before you file.

## What the Town and the fire district may require

Town Code Chapter 138 requires a permit from the Building Inspector for a fence or [stone wall](https://portillo-fences.com/stone-walls/), with a plan showing the fence in relation to buildings, structures and property lines. The Town's FAQ lists a 36-inch limit across the front property line in the listed residential districts, with the side-line distance varying by district. Bring a layout that shows where the gate swings or slides.

Fire access has its own rule. Section 503.6 of the Fire Code of New York State requires a security gate across a fire apparatus access road to be approved by the fire code official and to have an approved means of emergency operation that stays working. Section 506.1 lets the fire code official require a key box where a secured opening restricts emergency access. The [Brewster](https://portillo-fences.com/brewster-ny/)\-Southeast Joint Fire District serves the area, and its local material includes an example calling for a larger emergency gate opening and a Knox box holding the gate-lock key. Whether your gate needs either one is the fire code official's call, so ask the district at 501 North Main Street, (845) 279-9229, before the operator is ordered.

## UL 325 and ASTM F2200 on a driveway gate

UL 325 applies to residential operators as well as commercial ones. LiftMaster describes the requirement as two monitored safety entrapment protection devices at each entrapment point, combining the operator's inherent reversing system with monitored photo eyes or edge sensors. If an external device is not monitored, the operator is limited to constant-pressure operation in that direction.

On a horizontal slide gate, LiftMaster's checklist calls for photo eyes in both directions, edge sensors on the leading and trailing edges, and protection at draw-in zones. Openings in the gate and the adjacent fence should be under 2-1/4 inches or be guarded. ASTM F2200-24 covers gate construction and entrapment protection and sorts [gates](https://portillo-fences.com/gates/) into classes; Class I covers a garage or parking area serving a one-to-four-family home. Our [UL 325 entrapment guide](https://portillo-fences.com/blog/gate-entrapment-ul-325-residential/) goes through each device.

![Gate operator, monitored photo eyes and a sensing edge laid out on a workbench before installation](https://portillo-fences.com/images/blog/automatic-gates-brewster-ny/operator-and-safety-devices.jpg)

Two monitored entrapment protection devices are required at each zone, so the safety devices are priced as their own lines.

## Wiring, burial depth and the ground under it

Table E3803.1 of the 2024 Residential Code of New York State lists minimum cover for underground wiring:

- **Direct-burial cable or conductors**: 24 inches
- **Rigid or intermediate metal conduit**: 6 inches
- **Electrical metallic tubing or listed nonmetallic raceways**: 18 inches
- **120-volt, 20-amp GFCI residential branch circuit**: 12 inches
- **Low-voltage control circuit, 30 volts or less, in UF cable or another identified cable or raceway**: 6 inches

Warning ribbon is required over service conductors buried 18 inches or deeper, and conductors need protection where they leave the ground. FAAC's installation manual calls for conduit and for keeping low-voltage accessory cables apart from the 230- or 115-volt supply. Confirm the table the Building Inspector applies to your job.

Footing depth for gate posts and the operator pad is a separate number. New York leaves the frost depth to each municipality, so ask the Village or Town inspector for the depth at your address. Overburden around [Brewster](https://portillo-fences.com/brewster-ny/) runs from shallow to deep over bedrock, so one parcel can differ from the next. Run the parcel through USDA Web Soil Survey and verify what is under the trench during layout.

![A narrow trench cut across a driveway edge with conduit laid in it and a ledge outcrop exposed at one end](https://portillo-fences.com/images/blog/automatic-gates-brewster-ny/conduit-trench-with-ledge.jpg)

Direct-burial cable needs 24 inches of cover, while a low-voltage control circuit in an identified raceway needs 6.

## What it costs to run

FAAC lists its 415 operator at 300 watts in the 230-volt version and 70 watts in the 24-volt version, which are operating power figures and not annual energy costs. The E024U control board draws 4 watts on standby and up to 400 watts at maximum, and it accepts a 24-volt backup battery. FAAC's solar document shows a 24-volt battery pack, charge regulator and panel, and states that with 10 daily openings the example system consumes 2.5 watts. LiftMaster's CSL24UL guide gives battery backup of up to 500 cycles or 24 days of standby. FAAC recommends a general system check every six months, with attention to the safety devices. Ask your installer for a maintenance price covering the operator, safety devices and [access control](https://portillo-fences.com/access-control/) you choose.

## What installed automatic gates cost

## Frequently Asked Questions

**Q: Does an automatic gate need an electrical permit?** A: The Town says a building permit is required before installation of electrical systems, and fire underwriters assist with electrical review. In the Village, ask the Building Department which permit and fee cover the wiring.

**Q: Will the fire district require a key box?** A: Section 506.1 allows the fire code official to require one where a secured opening restricts emergency access. Ask the Brewster-Southeast Joint Fire District at (845) 279-9229 whether your gate needs a Knox box or a wider emergency opening.

**Q: What happens if the gate goes in before the permit?** A: The Town's fee schedule lists $250 for work performed before permit issuance, on top of the permit fee.

**Q: How long does the Town take to approve a permit?** A: The Building Inspector approves or denies within 15 working days after filing. If the project needs site plan or special permit approval, the period starts after final Planning Board action.

**Q: What does it cost to power a gate?** A: FAAC lists 4 watts of standby draw for the E024U board. Annual electricity depends on standby load, daily cycles, local rates and accessories such as heaters or intercoms.

**Q: Can a gate run on solar?** A: FAAC documents a solar setup with a 24-volt battery pack, charge regulator and panel. Sizing depends on the whole system and the number of daily cycles.

Gate type, safety devices, trenching and the permit path all move the price, and each can be settled on the first site visit. Have the parcel's municipality confirmed from your tax record, and ask the fire district about emergency access before the operator is ordered.
