## Which office handles your fence

Inside the Village of [Brewster](https://portillo-fences.com/brewster-ny/), fence permits go through the Village Building Department and Code Enforcement office at 50 Main Street, Brewster, NY 10509, phone 845-279-3760. Building Department appointments run Monday and Wednesday from 9:00 a.m. to 3:00 p.m., with Friday and Saturday appointments by request. Village Hall is open Monday through Thursday, 8:00 a.m. to 5:30 p.m., and closed Friday.

## When a repair needs a permit

The Town rule is specific. Under §138-102(A), no permit is required for a fence or [stone wall](https://portillo-fences.com/stone-walls/) to be replaced, repainted or repaired consistent with its original location, form, design and dimensions. The section sets no percentage, footage or panel count, so a true like-for-like repair is exempt however much of the fence it covers. Moving the line, changing the height or switching from a picket to a privacy design is a change of form or dimensions, and §138-101(A) applies.

The Village is less clear-cut. Village Code §263-17(P)(8) requires a permit from the Code Enforcement Officer before work to construct or install a fence, stone wall or masonry wall. Separately, Chapter 103, §103-4(B)(6), allows an exemption for repairs that do not involve removal of structural components or other listed changes. The fence provision states no percentage or length for replacing sections, so call the Code Enforcement Officer at 845-279-3760 before you replace posts or a long run.

New York's own rule, 19 NYCRR §1203.3(a)(1), lets a local authority exempt certain repairs that do not affect fire and life safety, and it lets local programs be stricter. It sets no fence-specific percentage or length either.

## Rocky ground and frost around Brewster

Soil maps for the Brewster area list Charlton and Chatfield soils, including units described as very rocky. Charlton is deep, more than 80 inches to a restrictive layer, while Chatfield may have bedrock at roughly 20 to 41 inches. A post hole that hits ledge at 24 inches cannot be dug to the depth a plan assumed, and that is a repair-day surprise worth pricing in advance.

No municipal fence-post frost depth is posted for Brewster or Southeast. Lumber two inches thick or less may be treated only for above-ground use, so read the tag on any post you plan to reuse or replace. The soil line is where posts fail first, and service life depends on species, preservative, drainage and moisture.
