A pool barrier in [Brewster](https://portillo-fences.com/brewster-ny/) has to be at least 48 inches high, with no more than 2 inches between the ground and the bottom of the barrier, and every gate has to be self-closing and self-latching. Those are the figures in Section R328.4.2.1 and R328.4.2.7 of the 2025 Residential Code of New York State, which covers a pool at a one- or two-family house.

The permit goes through the Village of [Brewster](https://portillo-fences.com/brewster-ny/) Building Department if the pool is inside the village, or the Town of Southeast Building Department if it is not. Brewster Hill, Dykemans and Deans Corners are in the Town.

A temporary barrier is required during installation, and the permanent barrier must replace it within 90 days of permit issuance or the start of installation (R328.4.1.1 and R328.4.1.2).

## Who permits and inspects

Inside the Village of [Brewster](https://portillo-fences.com/brewster-ny/), the Village Building Department handles permits and construction monitoring from Village Hall, 50 Main Street, Brewster, NY 10509, phone 845-279-3760, Monday through Thursday from 8:00 a.m. to 5:30 p.m., closed Friday. For a pool outside the village, the Town of Southeast Building Department at 1 Main Street, phone 845-279-2123, Monday through Friday from 9:00 a.m. to 4:30 p.m., handles permits and inspections under Town Code Chapter 54. The Town says swimming pools require permits.

The Village fee schedule lists an in-ground pool at a $250 permit fee plus $5.00 per thousand of job cost plus a Certificate of Compliance, an above-ground pool at $125.00 plus a Certificate of Compliance, and fences and walls over 36 inches at $100.00 plus $5.00 per thousand of demolition cost. The posted schedule carries a July 19, 2018 effective date, so confirm the current figures with the Village. The Town's 2026 schedule runs by project size: $150 under $10,000, $330 from $10,000 to $30,000, and $330 plus $6 per thousand over $30,000, with a $55 Certificate of Occupancy and Compliance and a $75 re-inspection or no-show fee. The Town schedule has no pool-specific line, so ask which fee applies.

When you file, ask the office for its current review time and for which inspections must pass before the pool is filled. Also ask whether any Putnam County Health Department filing applies to your pool.

## The barrier figures

The 2024 International Swimming Pool and Spa Code, §305.2.1, also states a 48-inch height and a 2-inch clearance over grass or gravel, and allows up to 4 inches over a solid surface such as concrete. The residential code reads 2 inches, so build to 2 inches and confirm with your building office.

A gate alarm does not replace the gate itself. The code requires the barrier gate to be self-closing and self-latching, and alarms are a separate requirement. The 2025 Property Maintenance Code, §303.3, requires an approved pool alarm for a pool installed, built or substantially modified after December 14, 2006, subject to the safety-cover exceptions.

R328.4.2.7 requires the gate to close and latch on its own and the pedestrian gate to swing outward.

## Two questions to settle with the building office

Two parts of the barrier code read differently depending on the edition. Which edition and which reading your office applies is the code official's call, so take both questions to them before you buy material.

**Chain-link mesh.** The 2020 Residential Code of New York State, R326.4.2.5, allows a mesh of 2 1/4 inches square unless slats fastened at the top or bottom reduce the openings to no more than 1 3/4 inches. The 2025 code, R328.4.2.5, and the International Swimming Pool and Spa Code (§305.2.7 in the 2012 edition, §305.2.8 in 2024) read 1 3/4 inches, with slats allowed to bring larger openings down to that size. **House wall as part of the barrier.** Under R328.4.2.8 of the residential code, a dwelling wall can form part of the barrier if it meets the barrier requirements and one listed protection method is provided. The first method is a door alarm listed to UL 2017 that sounds within 7 seconds, continues for at least 30 seconds, is audible throughout the house, and has a deactivation switch at least 54 inches above the threshold. Windows with direct pool access and a sill below 48 inches inside and 72 inches outside need a latch at least 48 inches up and an opening that stops a 4-inch sphere. The 2012 ISPSC, §305.4, also requires a UL 2017 alarm on doors and low windows, and adds that one or more additional protection methods are required, such as a powered safety cover or a barrier between the house and pool. The side next to the house is the one the barrier code treats differently, so settle it before you price the other three.

## Town and Village add-ons

The Town of Southeast adds a zoning rule: Town Code §138-26(B) says no swimming pools may be located within the front yard of any residential or commercial use. Fences and walls fall under §138-27(C), which allows 3 feet along a lot line and 6 feet along the part of the lot line behind the required front yard, so keep the barrier behind the required front yard and confirm the placement with the Building Department. Confirm setbacks from side and rear property lines and from a septic system with the Town or Village Building Department before excavation. Chapter 42 of the Residential Code covers electrical wiring and equipment for all swimming pools. For a hot tub, ask whether a safety-cover exception applies or a full barrier is needed.

The footing depth for pool-fence posts is set by the building office, so ask for it for your fence and soil conditions before digging.

These are national figures for fences 4 to 5 feet tall, installed, and none is a Brewster bid.
