# When to Install a Fence in the Hudson Valley

What sets a fence install date in the Hudson Valley: frost depth, utility markouts, permit review, cold-weather concrete and how long before a gate is hung.

A fence can go in whenever three things line up: the permit is issued, the utility marks are valid, and the post holes reach thawed soil below the local frost line. The calendar matters through those three, and through what cold does to the concrete in the holes.

## The utility markout sets the earliest dig date

Under 16 NYCRR Section 753-3.1(a), nonemergency excavation requires notice to the one-call system at least 2 working days and no more than 10 working days before the planned start, not counting the day of the call. Fence-post work counts: Section 753-1.2(i) defines excavation to include fence-post driving and related digging. If the work is postponed 10 working days or less, no new call is needed. If it slips past that, the notice requirements apply again to the new start date, and Dig Safely New York says marks remain valid for 10 working days. Once marks fade or the job runs past that window, a fresh markout comes before digging resumes. The tolerance zone is 2 feet on either side of the marked centerline, plus one-half of the facility diameter when it is known.

Ask the contractor when the call was placed and what happens if the start date moves.

## Frost depth is set town by town

The 2020 Residential Code of New York State does not assign one statewide frost-line depth. Table R301.2(1), footnote b, has the local jurisdiction fill in the minimum footing depth below finished grade. For fence posts, that means the post holes follow your town's number, not a county average. Published local figures:

- **Westchester County, City of [Peekskill](https://portillo-fences.com/peekskill-ny/)**: a frost-line depth of 42 inches in its Table R301.2
- **Ulster County, City of [Kingston](https://portillo-fences.com/kingston-ny/)**: 48 inches in its Table R301.2, a figure that should not be applied automatically to every Ulster municipality
- **Orange County**: project specifications call for water-line excavation below a minimum frost depth of 42 inches, which is a project specification and not a universal fence-post rule
- **Putnam, Dutchess and Rockland Counties**: the state code assigns no countywide figure. [Carmel](https://portillo-fences.com/carmel-ny/) and the other Putnam jurisdictions control their own depth, and the code places Dutchess and Rockland Counties in Climate Zone 5A while the local building department supplies the number

Manufacturers point the same way. CertainTeed Bufftech's vinyl instructions specify typical post holes of 30 inches and tell the installer to check local frost-line requirements, and they warn that some installation methods can crack posts in freeze-thaw climates. Weatherables' aluminum guide says to check local frost-line rules and utility locations. Treated Wood's fence guidance says to dig at least several inches below the local frost line and to use 4 to 6 inches of packed gravel under the post to reduce moisture and frost-related uplift.

## Pouring concrete in cold weather

ACI 306R-16 sets minimum concrete temperatures as placed and maintained, by section size:

The temperature of the concrete as mixed has to be higher, and it rises as the air gets colder. Above 30°F air, the minimums are 60°F, 55°F, 50°F and 45°F for those four section sizes. From 0°F to 30°F, they are 65°F, 60°F, 55°F and 50°F. Below 0°F, they are 70°F, 65°F, 60°F and 55°F. Ask your contractor or concrete supplier which section size applies to your post footings.

ACI 306.1-90, Section 3.1, requires snow, ice and frost to be removed from contact surfaces and the subgrade to be thawed to the depth specified in the contract documents. It warns that frozen subgrade can freeze newly placed concrete or cause foundation settlement when the ground thaws. The University of Delaware's guidance lists cold-weather precautions when air falls below 40°F or stays below 50°F for more than 12 hours, and says normal placement is not permitted on frozen subgrade or when contact surfaces are below 35°F.

For a fence, that means frozen soil has to be thawed or excavated with equipment that reaches unfrozen bearing soil, and concrete does not go against frozen soil, ice or snow. A material can stay usable in cold weather. Frozen excavation surfaces, brittle vinyl handling and concrete placed against frozen soil are what compromise an installation. Follow the instructions for the product you chose, and ask whether the concrete supplier requires cold-weather procedures.

## Permit review and lead time

[Peekskill](https://portillo-fences.com/peekskill-ny/)'s Building and Code Enforcement page says applications are processed in the order received and can take up to two weeks, and it lists fences as work requiring a permit, with a fence-permit application. Yorktown publishes a fence-permit application and requires a building permit before a structure is erected, enlarged, altered or moved. [Kingston](https://portillo-fences.com/kingston-ny/) publishes Building Safety permitting information and an online portal, and historic-district [fencing](https://portillo-fences.com/fencing/) there may need historic-preservation review before the building permit.

For Southeast, [Carmel](https://portillo-fences.com/carmel-ny/), Yorktown, [Middletown](https://portillo-fences.com/middletown-ny/) and [Kingston](https://portillo-fences.com/kingston-ny/), ask the building department for the current review timeframe before you schedule any excavation, and ask whether workload or meeting schedules affect timing. For the contractor's side of the calendar, ask for the current estimated start window for your property and your material, in writing.

## When the gate can be hung

Concrete has to set before a gate goes on a post. Product instructions give different figures:

- **CertainTeed Bufftech and Catalyst vinyl**: leave the gate on blocks for 72 hours while the concrete sets
- **SimTek**: allow the concrete to cure for 48 to 72 hours before continuing
- **Sika PostFix**: expands in about three to five minutes, and should set for about two hours before the fence is installed or [gates](https://portillo-fences.com/gates/) are attached. Hold or brace the post in cold or windy conditions until it stands firm
- **Quikrete fast-setting concrete**: at 70°F, it sets in 20 to 40 minutes, and heavy loads should wait about four hours

Those are product instructions, not a universal working-strength rule. Cooler weather slows setting and strength development, so keep the gate supported for the period the concrete and fence manufacturers specify, and longer when it is cool or freezing.

## Staining new pressure-treated wood

Treated Wood says pressure-treated lumber commonly dries enough for finishing about 60 days after installation, depending on how long it had already been drying, sun exposure, temperature, weather and airflow. Test it: a few drops of water that soak in mean the wood will accept stain, paint or sealant, and drops that bead on the surface mean more drying. Cooler, wetter or shaded conditions can stretch the 60 days.
