Who reviews a commercial fence

Village Hall at 50 Main Street, (845) 279-3760, is open Monday through Thursday from 8:00 a.m. to 5:30 p.m. and closed Friday. Village Code Chapter 103 gives the Code Enforcement Officer the job of receiving, reviewing and issuing building permits, and Chapter 263 assigns zoning administration to the same officer. A fence that meets the dimensional rules of Chapters 182 and 263 does not need separate site plan approval on a lot already subject to it, and the site plan submission shows existing and proposed fences, landscaping and screening.

The Town Building Department at 1 Main Street, (845) 279-2123, is open Monday through Friday from 9:00 a.m. to 4:30 p.m. and accepts permit applications until 4:00 p.m. Town Code Chapter 138 requires the fence permit from the Building Inspector. An ordinary fence is exempt from site plan review unless it belongs to a larger application that needs one. When Architectural Review Board review applies, the Building Inspector refers a complete application within 15 days.

Heights, outside storage and screening

The Town allows a fence of 3 feet along any lot line and 6 feet behind the required front yard, and up to 10 feet only when set back two-thirds of the required setback. Nothing over 3 feet may stand inside the sight triangle at a street intersection. For outside storage, Section 138-45 lets the Planning Board permit a fence taller than normal within a setback area, up to 6 feet, when it improves the appearance of the storage area and creates no health, safety or traffic risk. Storage may not extend into required setback yards and generally may not exceed 5% of the lot. Section 138-50 calls for a landscaped buffer of at least 20 feet along a lot line that abuts or faces a residential district, and a Planning Board-approved wall or fence can replace the evergreen planting. Village Chapter 263, Section 263-32, requires plans to show outside storage and display areas.

The Town's fence article states no barbed-wire or razor-wire specification. If the job calls for security wire, submit the detail to the Building Inspector and the applicable board before you order materials.

Fees and review time

The Town's 2026 fee schedule lists these Building Department charges:

If the fence rides on a site plan application, minor projects under 10,000 square feet list a $75 pre-application meeting, $300 sketch plan review, $500 plus $150 per 1,000 square feet of new gross floor area for preliminary review, $150 for final review and a $2,000 escrow. State highway frontage

New or modified access to a state highway needs a NYSDOT highway work permit, as does a change of use or expansion of an existing commercial development on one. Under the Building Code, Section 1010.2 requires egress doors to open from the egress side without a key, special knowledge or special effort, and Section 1010.4 applies those door rules to gates in a means of egress. New York's 2025 Residential Code leaves the frost-line footing depth to the authority having jurisdiction.
