Which office, and what it requires
The Village Office of Code Enforcement is at 50 Main Street, (845) 279-3760, open Monday through Thursday from 8:00 a.m. to 5:30 p.m. and closed Friday. The Town of Southeast Building Department is at 1 Main Street, (845) 279-2123, with Town offices open Monday through Friday from 9:00 a.m. to 4:30 p.m. A Brewster mailing address does not put an unincorporated property under village rules, so confirm the boundary on your tax record before filing.
In the Town, Chapter 138 allows a fence or wall of 3 feet along any lot line and 6 feet behind the required front yard, and up to 10 feet only when it sits back from the lot line by two-thirds of the required setback. Nothing over 3 feet may stand in the sight triangle at a street intersection. The Village caps a fence at 4 feet in a front yard and 6 feet in a rear yard, with no separate open-versus-solid rule.
The Village schedule dated April 4, 2019 lists a $100 permit fee for fences and walls over 36 inches, plus $5 per thousand of demolition cost, and a $100 Certificate of Occupancy or Compliance. The Village has posted a revised schedule, so confirm the current figure. Its permit instructions ask for a completed application, the tax map number, your contractor's license number, a description of the work, and liability insurance and workers' compensation documentation. The Town's 2026 schedule lists $150 for a project under $10,000, $330 from $10,000 to $30,000, $330 plus $6 per thousand above that, a $55 Certificate of Occupancy and Compliance and a $75 re-inspection fee, with no aluminum-specific line. Under Chapter 138 the Building Inspector approves or denies a building permit within 15 working days when no site plan or special permit approval is needed, and residential fences on residential properties skip Architectural Review Board review. Ask the Village office for its review time.
The 2025 pool barrier numbers
New York's 2025 code took full effect on December 31, 2025, and the Department of State points to Section R328 for residential pools. For a picket-style aluminum barrier, the sections that matter are:
- R328.4.2.1: at least 48 inches above grade and no more than 2 inches between grade and the bottom of the barrier, both measured on the side facing away from the pool
- R328.4.2.3: where horizontal members are less than 45 inches apart, vertical openings no wider than 1-3/4 inches
- R328.4.2.4: where horizontal members are 45 inches or more apart, vertical openings no wider than 4 inches, with decorative cutouts still held to 1-3/4 inches
- R328.4.2.7 and its subsections: gates meet the opening and height rules, are self-closing and self-latching, and a pedestrian gate opens outward, away from the pool
- Locking: all gates securely locked with a key, combination or child-proof lock when the pool is not in use or supervised
The code does not approve an aluminum product by name, so the panel, picket spacing, horizontal-member layout, bottom clearance and gate hardware are each checked against these sections. The permit follows the code the local authority enforces. Slopes: racking, stepping and gates
Rackable panels follow the grade by letting rails and pickets adjust between posts. Stepped panels stay level and change elevation at the posts. UltraLox's instructions say panels may be racked up to 8 degrees, that sloped terrain shortens the distance between posts, and that over-adjusting leaves pickets loose or rattling. Test-fit panels on the ground and cut at an angle where needed. ActiveYards' racking gate instructions give a maximum of 10 degrees, or 12-3/4 inches of elevation change, for the configuration in that guide. Those limits belong to each product line, so check the rack rating of the system you buy.
Gates generally cannot be racked, because the hinge and latch posts have to stay plumb and level with each other. When the slope exceeds a panel's rack rating, use stepped panels, shorter sections or a slope-specific bracket. A pool barrier has to hold its 2-inch bottom clearance and its opening limits through every grade change.

Footing depth
New York leaves the minimum footing depth to each jurisdiction through Table R301.2(1), and the state table does not enter a Brewster or Southeast figure for you. Ask the Village Office of Code Enforcement or the Town Building Inspector for the depth at your address before excavation.

Manufacturing time matters in planning. Ametco states a typical lead time of 8 to 10 weeks after approved, field-verified drawings for custom aluminum and architectural products.
